2. Applicability

• These terms apply to all purchases made via www.earthshake.co.
• By placing an order, you agree to these terms.

3. Products & Pricing

• All prices are in EUR (€) and include 9% VAT
• Prices are subject to change, but the price at the time of order applies.

4. Orders & Payment

• Payment methods: iDEAL, Credit Card, PayPal, Bank Transfer, etc.
• The order is confirmed once payment is received.
• We reserve the right to cancel orders due to stock issues or fraud detection.

5. Shipping & Delivery

• Estimated delivery time: [1-3 days] (depending on location).
• If a product is out of stock, the customer will be notified.
• Earthshake is not responsible for delays caused by third-party couriers.

6. Returns & Right of Withdrawal

• Customers have 14 days to return products without stating a reason (EU Consumer Law).
• Products must be unopened and in original condition.
• Refunds are processed within 30 days after receiving the return.

7. Warranty & Liability

• Products come with a [ 2 years ] warranty against defects.
• Earthshake is not liable for improper use of the products.

8. Privacy & Data Protection (GDPR Compliance)

• Customer data is processed in accordance with our Privacy Policy.
• We do not share customer information with third parties without consent.

9. Governing Law & Dispute Resolution

• These terms are governed by Dutch law.

• These terms govern agreements between Earthshake and its suppliers/manufacturers.
• Any deviations must be agreed upon in writing.

2. Payment Terms

• 60% deposit upon order confirmation.
• 40% remaining balance payable within 30 days of delivery.
• Payment will be made via [Bank Transfer/Other Agreed Method].
• Failure to meet delivery terms may result in delayed or withheld payments.

3. Product Quality & Compliance

• All products must meet food safety regulations and quality standards.
• Suppliers must provide necessary certifications (organic, SKAL certification).

4. Delivery & Risk Transfer

• Delivery timelines must be followed as per agreement.
• Risk of loss/damage transfers to Earthshake only upon successful delivery and inspection.
• Late deliveries may result in penalties or order cancellation.

5. Liability & Indemnification

• The supplier is responsible for ensuring products are safe and compliant.
• Any legal claims due to product defects will be the supplier's responsibility.

6. Confidentiality

• All business information, pricing, and agreements must remain confidential.
• Suppliers must not disclose details to third parties without consent.

7. Governing Law & Jurisdiction

• All agreements are governed by Dutch law.
• Disputes shall be handled by the competent court in the Netherlands.
